Agreement to Terms

By accessing or using CallAgent.pro ("Service," "Platform," or "we"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

Description of Service

CallAgent.pro provides AI-powered phone assistant services that enable businesses to:

  • Handle incoming and outgoing phone calls using artificial intelligence
  • Configure and customize AI agents for various use cases
  • Integrate phone systems with existing business workflows
  • Access call recordings, transcripts, and analytics
  • Manage multiple phone numbers and campaigns

Account Registration

Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use our Service. By registering, you represent and warrant that you meet these requirements.

Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Ensuring your account information is accurate and up to date

Acceptable Use

Permitted Uses

You may use the Service for lawful business purposes, including:

  • Customer service and support
  • Appointment scheduling and reminders
  • Lead qualification and sales
  • Information collection and surveys
  • Order processing and confirmations

Prohibited Uses

You agree NOT to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights
  • Make unsolicited marketing calls (spam or robocalls)
  • Engage in harassment, threats, or abusive behavior
  • Impersonate any person or entity
  • Collect personal information without consent
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any systems
  • Use the Service for fraudulent or illegal activities
  • Violate telemarketing laws or regulations (including TCPA, Do Not Call lists)

Compliance with Telecommunications Laws

You are solely responsible for ensuring your use of the Service complies with all applicable telecommunications laws and regulations, including but not limited to:

  • Telephone Consumer Protection Act (TCPA)
  • Telemarketing Sales Rule (TSR)
  • National Do Not Call Registry requirements
  • Call recording and consent laws in applicable jurisdictions
  • GDPR and other data protection regulations

You must obtain proper consent before recording calls where required by law.

Subscription Plans and Billing

Free Trial

We offer a 14-day free trial for new users. No credit card is required for the trial. Your trial will automatically end after 14 days unless you subscribe to a paid plan.

Paid Subscriptions

Subscription fees are billed in advance on a monthly or annual basis. By subscribing, you agree to:

  • Pay all applicable subscription fees
  • Automatic renewal unless you cancel before the renewal date
  • Price changes with 30 days' notice
  • Usage-based charges for minutes exceeding your plan's allocation

Payment Terms

  • All fees are non-refundable except as required by law
  • You must provide valid payment information
  • We may suspend access for non-payment
  • Disputed charges must be reported within 30 days

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access until the end of the paid period.

Intellectual Property

Our IP

The Service, including all software, content, trademarks, and technology, is owned by CallAgent.pro and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service.

Your Content

You retain ownership of any content you provide to the Service (call scripts, knowledge base content, recordings). By using the Service, you grant us a license to use, process, and store your content solely to provide the Service and improve our AI models.

Data Privacy

Your use of the Service is also governed by our Privacy Policy. We collect, use, and protect your data as described in the Privacy Policy. By using the Service, you consent to our data practices.

Service Availability

While we strive for high availability:

  • We do not guarantee uninterrupted or error-free service
  • We may modify, suspend, or discontinue features with notice
  • Scheduled maintenance will be communicated in advance when possible
  • We are not liable for service interruptions or data loss

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
  • WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE LAST 12 MONTHS
  • WE ARE NOT RESPONSIBLE FOR THIRD-PARTY SERVICES OR CONTENT
  • YOU USE THE SERVICE AT YOUR OWN RISK

Indemnification

You agree to indemnify, defend, and hold harmless CallAgent.pro and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

Termination

We may terminate or suspend your access immediately, without notice, for:

  • Violation of these Terms
  • Suspected fraudulent or illegal activity
  • Non-payment of fees
  • At our discretion for any reason

Upon termination, your right to use the Service ceases immediately. Provisions that should survive termination (payment obligations, indemnification, limitations of liability) will remain in effect.

Dispute Resolution

Governing Law

These Terms are governed by the laws of the European Union and the jurisdiction where CallAgent.pro is registered, without regard to conflict of law principles.

Arbitration

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law. You waive the right to participate in class actions.

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use after changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service.

Miscellaneous

Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and CallAgent.pro.

Severability

If any provision is found unenforceable, the remaining provisions will remain in full effect.

No Waiver

Our failure to enforce any right or provision does not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms at any time.
